General terms and conditions of sale
The current regulations regarding shop online are govern by the EU Directive 2011/83 on consumer rights.
Subject of the general conditions and contract
These general conditions of sale govern the purchase of Gruppo Verriello via the e-commerce website and how to access on (the website). The contract subject is the sale by the company under the conditions, procedure, time and service quality levels such as resulting from this general condition.
Registration on e-commerce website
In the course of completing the website registration procedures, the Customer undertakes to follow the company indication and to provide their own current personal data accurately and truthfully. Registration is free and this is verified and approved. Subject to the registration procedure is only concluded via telematics, each Customer chooses an email and password. The Customer acknowledges that these email and password constitute the validation access system to the section of the e-commerce website. The Customer acknowledges and agree that these email and password constitute the only ways to identify himself/herself during the service access. Therefore, the Customer agrees upon with all acts done using mentioned email and password that will be attributed to him univocally and will take effect and will be binding to him/her. The Customer acknowledges to be the only responsible of the acts done with own email and password and the Customer undertakes to maintain secrecy and to guard with due care and diligence and not to give these also only temporarily to a third party.
Customer obligations and declarations
The Customer declares and guarantees:
- To use the service offers by the company lawfully and to respect conditions of the service use;
- To be an adult
It being understood that the company reserves the right, if the Customer violates one of the guarantees provided, to block his/her access to e-commerce site for temporary or permanent time and to take on a lawsuit of the case.
Purchase method
The purchase of the products takes place through the following procedure:
- Registration
- Authentication with the use of email and password (login)
- Choice of the product
- Compiling the order with necessary data at the end of the contract
- Confirm
- Verification of the data and the terms of sale
- Confirm and send the order
The order made by the Customer through the authentication steps with email and password is a binding order and the sales contract will be ended when the customer receive the order confirmation except for the right of withdrawal classified to the Customer. The order confirmation will be sent to the email address provided by the Customer during the registration phase and it will contain a summary of the sales conditions, the information and essential characteristics of the good, detailed indication of the price, payment and withdrawal method and shipping cost. If the company has a temporary or definitive unavailability of the goods, it is committed to communicate promptly the Customer, and in any case not later than 30 days and will provide to give back how possibly already paid through a reimbursement and/or a voucher equivalent to the value of the products. Let it be known that both the order and receipt is considered reached when parties have the possibility to received it.
By requesting a telephone order, you consent on the use of your personal data respecting the privacy law. Your data will be used only for the execution of the order and it will not be divulged to third parties.
Products
The Customer is well-informed and acknowledges that the illustrative photographs of the products are merely approximate, and their graphic appearance may be different and not coincide with the photographs. For each product will be available a description of the main characteristics of the goods and only this description shall prevail for the identification of the product aim of the sales contract and its characteristics.
Payment method
All product prices are VAT included. The site accepts payment by credit card, PayPal and bank transfer.
The product delivery will be commissioned to third-party couriers. After verification of your payment, deliveries will take place approximately within 2/3 days from the taking charge by the courier, except for unforeseen circumstances independent from the will of the company. In any case, delivery times cannot 30 days from receipt of the order, except different and specific agreed.
The company, from the moment of delivery to courier, does not assume any more responsibility for the loss or damage of things, except for fraud or serious negligence. The company will not responsible for any disappear or damage after delivery to the customer, except for fraud or serious negligence.
The company will communicate to the courier the data provided by the Customer in the order, so will not be responsible for errors or inaccuracies.
Withdrawal method
In accordance with the current regulations, the Customer has the right to withdraw from the contract of purchase for any reason and without provide explanations, to the conditions explained below. The Customer, who intends to exercise the right to withdraw, must send a communication in this sense within 14 working days from the date of receipt of the products. The company will reimburse within 14 days from the day when the company was informed of the Customer’s decision to withdraw.
The company may suspend the reimbursement until receipt of the products or until demonstration by the Customer that the products were sent, depending on which situation occurs first. The Customer is only responsible for any decrease in the value of the products as a result of handling them in a manner other than what is strictly required to establish the nature, characteristics, and function of the products. In case of return of the products, the gifts received with the order remain to the Customer.
The reimburse will be through the same payment means chosen by the Customer during the purchase. In case of payment by cash on delivery, the reimburse will be through bank transfer to the coordinates that the Customer will commit to provide to the company.
Guarantee of compliance
The company applies the legal guarantee of compliance provided for and protects the Customer in the case of a purchase of defective products, which malfunction or do not respond to the use declared by the seller or to which that product is generally intended.
Product to be returned
The return is always free in Italy, for foreign countries the return is charged to the user. The company, at complete guarantee the Customer, undertakes to replace any product in the package and does not in compliance to the description, damaged, different from the order or, in any case, to reimburse the relative amount on simple Customer’s request to info@gary.it.
Modification of sales conditions
In case of any change to these sales conditions, the company will promptly publish the new conditions modified on the site.
The modified sales conditions will become integral part of the new contacts, starting from the date of the first order sent by the Customers following their publication on site. In case orders are already sent before the communication, the previous sales conditions will apply.
